Bombay HC quashes Eknath Shinde’s stay on coop bank recruitment

The Nagpur bench of the Bombay high court has quashed the decision of Maharashtra Chief Minister Eknath Shinde to stay the recruitment process of a co-operative bank, noting that the CM has no powers to review or modify the calls taken by the minister concerned.

A division bench of Justices Vinay Joshi and Valmiki SA Menezes in its order of March 3 termed Shinde’s decision ”wholly unwarranted and without authority of law”.

The order was passed on a petition filed by Chandrapur District Central Co-operative Bank Ltd. and a businessman named Santoshsingh Rawat, who had been elected as its chairman, opposing Shinde’s decision.

According to the plea, the CM’s order was passed at the behest of local politicians.

 

The court held that the chief minister has no independent power assigned under the ’Rules of Business and Instructions’ to review or modify the decision taken by the in-charge minister.

”The intervention of the chief minister is wholly unwarranted and without the authority of law. The chief minister has no independent power under the Business Rules and Instructions to interfere into the subject which was allocated to the incharge-minister,” the court said in the order.

The CM was not the head of the ‘cooperation department’, but the said department was assigned to a separate minister, the bench said.

”There is no authority/power vested in the Chief Minister as per Rules of Business and Instructions to have supervisory powers over the decision taken by the concerned minister. Nor do the Rules indicate that the Minister is subordinate to the Chief Minister as regards independent functioning of a department assigned to him by the rules,” it added.

The court further held that the minister in charge of a department is responsible for the affairs thereof and the minister’s directives would assume the character of an order passed by the state government.

”No doubt the order of granting permission for recruitment is of administrative nature which can be reviewed, but only by the In-charge-Minister. The intervention of the chief minister is not authorized under the Business Rules and the Instructions issued thereunder,” it said.

The petitioners had said that the proposal for filling up 393 posts was sanctioned by the minister in-charge in September last year after an inquiry.

The plea further said that the CM’s order was passed at the behest of local politicians and that it did not take into consideration the fact that the bank was facing an acute staff shortage, making it impossible to run 93 branches.

The CM had in November 2022 stayed the recruitment process.

North Korea test-fires 2 more missiles as U.S. sends carrier

North Korea fired two short-range ballistic missiles into its eastern waters Monday, continuing its weapons displays as the United States moved an aircraft carrier strike group to neighboring waters for military exercises with the South.

South Korea’s Joint Chiefs of Staff said the two missiles were fired from a western inland area south of the North Korean capital of Pyongyang from around 7:47 a.m. to 8 a.m. and traveled around 370 kilometers (229 miles) before landing at sea. Japan’s military said the missiles flew on an “irregular” trajectory and reached a maximum altitude of 50 kilometers (31 miles) before landing outside Japan’s exclusive economic zone.

Japan has previously used the term to describe a North Korean solid-fuel missile apparently modeled after Russia’s Iskander mobile ballistic system, which is designed to be maneuverable in low-altitude flight to better evade South Korean missile defenses.

The launches came a day before the American aircraft carrier USS Nimitz and its strike group are to arrive at the South Korean port of Busan. South Korea’s Defense Ministry said the Nimitz and its strike group will participate in exercises with South Korean warships on April 3 in international waters near the South Korean resort island of Jeju.

The launches were the North’s seventh missile event this month and underscore heightening tensions in the region as the pace of both North Korean weapons tests and the U.S.-South Korea joint military exercises has accelerated in recent months in a cycle of tit-for-tat responses.

The South Korean and Japanese militaries denounced the North’s latest launches as serious provocations threatening regional peace and violating U.N. Security Council resolutions and said they were working with the United States to analyze the missiles further.

The United States and South Korea completed their biggest springtime exercises in years last week, which included both computer simulations and life-fire field exercises. But the allies have continued their field training in a show of force against North Korea’s expanding nuclear arsenal and belligerent threats of nuclear conflict.

North Korea has fired more than 20 ballistic and cruise missiles across 11 launch events this year as it tries to force the United States to accept its nuclear status and negotiate a removal of sanctions from a position of strength.

North Korea’s launches this month included a flight test of an intercontinental ballistic missile and a series of short-range weapons intended to overwhelm South Korean missile defenses as it tries to demonstrate an ability to conduct nuclear strikes on both South Korea and the U.S. mainland.

North last week conducted what it described as a three-day exercise that simulated nuclear attacks on South Korean targets as leader Kim Jong Un condemned the U.S.-South Korean joint military drills as invasion rehearsals. The allies say the exercises are defensive in nature.

The North’s tests also included a purported nuclear-capable underwater drone that the North claimed is capable of setting off a huge “radioactive tsunami” that would destroy naval vessels and ports. Analysts were skeptical about the North Korean claims about the drone or whether the device presents a major new threat, but the tests underlined the North’s commitment to expand its nuclear threats.

Following the North’s announcement of the drone test on Friday, South Korea’s air force released details of a five-day joint aerial drill with the United States last week that included live-fire demonstrations of air-to-air and air-to-ground weapons. The air force said the exercise was aimed at verifying precision strike capabilities and reaffirming the credibility of Seoul’s “three-axis” strategy against North Korean nuclear threats— preemptively striking sources of attacks, intercepting incoming missiles and neutralizing the North’s leadership and key military facilities.

North Korea already is coming off a record year in weapons testing, launching more than 70 missiles in 2022, when it also set into law an escalatory nuclear doctrine that authorizes pre-emptive nuclear strikes in a broad range of scenarios where it may perceive its leadership as under threat.

The Chicago Bulls spoiled superstar LeBron James’s return from a 13-game injury absence on Thursday, beating the Lakers 118-108 to tighten their hold on the final Eastern Conference play-in berth.

Zach LaVine scored 32 points to lead the Bulls, but all eyes were on James at Crypto.com Arena, where the 38-year-old forward came off the bench for just the second time in his 20-year NBA career, the only other occasion coming in December of 2007 when he was with Cleveland.

James, sidelined since February 26 with a tendon injury in his right foot, checked in to a standing ovation with the Lakers up 12-9 in the first quarter — going through his traditional hand-chalk toss near the scorer’s table before hitting the floor.

James led the Lakers with 19 points in 27 and a half minutes on court. Troy Brown and Malik Beasley added 18 apiece while Anthony Davis scored 15.

DeMar DeRozan scored 17 points with 10 assists for the Bulls, who are in 10th place in the East, three games ahead of the Washington Wizards for the final play-in tournament spot and just a hair behind Toronto for ninth.

“My hat’s off to the Chicago Bulls,” Lakers coach Darvin Ham said. “They’re sort of fighting to get in position like we are, to secure a position. They came out with a sense of urgency tonight. We came out a little flat, turned the ball over early. We weren’t aggressive enough, physical enough. We let one slip here at home.”

The Lakers, who had gone 8-5 in James’s absence, saw their three-game winning streak end.

They slipped from eighth to ninth in the Western Conference, half a game ahead of Oklahoma City and half a game behind New Orleans and Minnesota.

Elsewhere, the Dallas Mavericks’ downward spiral continued with a 110-104 loss to the Hornets in Charlotte, where Mavs star Luka Doncic received his 16th technical foul of the season, which will trigger an automatic one-game suspension.

Doncic scored 40 points, but it wasn’t enough to stave off a second loss in three days to the hapless Hornets — who are second-to-last in the Eastern Conference.

Gordon Hayward scored 22 points and P.J. Washington added 21 points with 12 rebounds for Charlotte, who have already been eliminated from post-season contention.

Dallas went into the day tied with Oklahoma City for the 10th-best record in the West, but were behind the Thunder in the race for the final play-in tournament berth because Oklahoma City hold the tiebreaker.

Doncic got off to a dismal start, going 0-for-6 from the field in the opening quarter. Dallas trailed by 19 late in the first half when Doncic drilled four three-pointers to key a Mavs run that cut the deficit to seven at halftime.

The Mavericks, who fell to eventual champions Golden State in the Western Conference finals last season, took their first lead of the game on a Doncic trey with 5:44 remaining.

Charlotte quickly regained the lead and Kyrie Irving’s three-pointer to again put the Mavs up by one proved little more than a blip as the Hornets again pulled away.
