NEW DELHI: In mounting trouble for the Delhi Police‘s Special Cell, National Human Rights Commission (NHRC) is learnt to have served a notice and sought documents and reports in connection with the death of a 24-year-old man named Ajay who was killed in a ‘fake encounter‘ on the night of May 16.

Delhi Police will have to submit the documents to the commission in six weeks.
The commission has served a notice to the deputy commissioner of police (outer-north) and district magistrate (northwest) who are carrying out their respective investigation into the case. The killing became controversial after it was alleged that Ajay was abducted by policemen of the “counter investigation unit” (CIU) of the special cell from Mount Abu in Rajasthan, brought to an isolated spot in north-west Delhi, given liquor and shot in cold blood. The cell has denied the allegations and claimed that the encounter was “genuine” and they had fired in “self-defence”.
The commission, sources said, had asked for details like the general diary entry of the departure and arrival time of policemen before and after the encounter. They have also sought the medico-legal certificate of the personnel allegedly “injured” in the encounter.
“NHRC has sought the site plan of the scene of occurrence, position of policemen and the deceased during the encounter and the post mortem and inquest reports. Police need to submit the recording of the post mortem,” an official said. NHRC also wants the magisterial inquiry report.
Besides statements of Ajay’s family, police need to provide the commission with an action-taken report on the complaint by Ajay’s relative, alleging a fake encounter. NHRC has sought the details and statements of independent witnesses and status of the probe.
Ajay was from Ritoli village in Rohtak, Haryana. He was said to be a neighbour of a gangster, Himanshu alias Bhau Ritolia. Police have claimed he was involved in a murder in Haryana, besides an incident of firing at a second-hand car dealer’s shop in west Delhi.
Bhau and his associates had released a statement through social media handles and alleged that Ajay was killed in a fake encounter. The encounter was carried out at an isolated location in Rohini’s Sector 29 by the “counter-intelligence unit” comprising additional DCP Manishi Chandra, ACP Rahul Vikram, inspector Nishant Dahiya and others. Special commissioner R P Upadhyay had also gone to the spot after the encounter. Police commissioner Sanjay Arora is monitoring the probe.
A Honda City with registration number T012UC, believed to be Ajay’s, was found at the scene. The police’s Scorpio SUV was found damaged with “bullet marks on the front windshield” and broken glass on the side window. Police found 15 empty cartridge shells and a 9mm pistol at the scene.
